PERB Success for MSJC FA
After the unfair dismissal from their Department Chair positions, Chemistry unit members Farah Firtha and Rosaleen Gibbons approached the Faculty Association for support. Initial grievances were unsuccessful and the District continued to put pressure on the faculty members to stop advocating for themselves and their students.
Despite being elected to the chair positions again by their peers, the District refused to reinstate them. MSJC FA continued to push for the right for the faculty members to be appointed to chair positions by their peers.
This case went to the Public Employee Relations Board (PERB) where the presiding official supported the Faculty Association’s case. The District appealed the case and once again the Faculty Association won the appeal.
This is a landmark case and one that is critical for every faculty member to read and understand. For that reason, we are posting the ruling in full here. Please take the time to read. If you have any questions, feel free to reach out to your Grievance Officers.
